Yeh, that scene and the whole episode were pretty ridiculous.
Wow, unbelievable! A trained federal agent (Valentine), is pointing her weapon at the chest of a suspect from about 10 yards away. The suspect has nothing in his hands, has his hands raised, and yet still manages to reach behind himself and pull a handgun tucked into the back of his pants, then turn and shoot Valentine in the belly, all without Valentine getting off a shot? If I could vote a -10 for that one scene alone, I would.
And don't get me started on the shaky camera motion. Will they never tire of that?
