Because it's not a title, Deadline is presuming a title. This is the Variety article they cite. Note that nowhere in the article is The Penguin given as the title of the show.

How's this any different from https://www.tvmaze.com/shows/49878/gotham-city-pd? Besides the fact that it already has a major star attached to the main role.
In any case, 'Penguin' is already listed in the production weekly.
The airdate has been edited too many times and the last person to update it fat fingered the year so it is currently 2020-12-15 when it should be 2021-12-15

Those images are screenshots from 10 year old episodes, so they are "fine" and shouldn't be deleted, but If you have higher quality images you can upload those of course.
